What I'm wondering is why she would turn the house over without getting anything out of it? I'd want to be bought out to get some money out of it. If I paid into the house I deserve that much.

Take a hint and look at the background of those giving you advice in this thread. I don't think I'd pay much attention to those who've previously proven their own faulty judgement in matters of the heart. :winky:

Your demonstrated failure does not mean P'nuthead can't find true love at that same age.

IMO it's best to go out into the world with good intentions and let life unfold before you as you live it. No preconditions = no broken expectations.

Damn, I was starting to wonder when you or Leon would finally react. :D



But I do think he needs to consider the source on any advice here. While I admit that anyone who's been through a failed marriage has some lessons to share, those experiences almost always come with an amount of emotional baggage. No sense for the guy to go forward as some type of misogynist, treating women like crap just to keep from getting hurt himself. Good guys don't need to be jerks just to find sex and love. :frou:

Legally if the house is in both of their names then he must buy out her portion in order to remove her name. She's stupid if she signs off and gets nothing.
Maybe so, but LEGALLY, if the house is in both their names, she has every responsibility to pay half the payments, too, lest her credit be jacked.

We've already concluded that she's "stupid", but she'd also be an even MORE immoral bish not to.

I am not above compensating her if we figure out that we need to be even. But I don't think that is going to happen, as I paid 70% of our expenses (including everything related to the house) for the last 6 months...she is intelligent enough to realize this, and I have been amiable enough to cooperate with me (thank god I did not take the advice of some and be a total dick. :D )

Researching "quit claim deed" now.
 
nope. she can sign it away w/o compensation if she so desires.....no one is going to check up and make sure she got half of the equity...no one really cares, and if you sign it away then its gone. just going to come down to who is the better negotiater.
 
your mortgage has two parts. the actual note/debt and the deed.

one can be on the deed, but not on the note, one can be on the note but not on the deed.....as you research this keep in mind that these two parts are independent of each other.

the quit claim deed, is her basically her giving up her rights to ownership of the house, and having her name taken off of the deed.

once that is done, then you need to refinance the mortgage into your name solely.

call your title company and they can help you through this and get you the quit claim form you need.

So a COMPLETE FAIL, would be to have her name on the deed, but not on the note, hence she would have full legal right to the house without ANY legal financial responsibility...sound 'bout right??
